Definition

Assault can occur in three ways: 1) a threat of imminent bodily injury, 2) offensive or provocative contact, or - most commonly - 3) causing contact that causes bodily injury to another. Assault involving bodily injury (including assault family violence/domestic violence) is usually Class A misdemeanor carrying a possible range of punishment of up to 1 year in jail and up to a $4,000.00 fine. Assault involving threats and offensive or provocative contact are usually Class C misdemeanors carrying a possible punishment range of up to a $500.00 fine. Aggravated Assault is usually a 2nd degree felony carrying a possible range of punishment of 2-20 years in prison and up to a $10,000.00 fine.
