Punishment Range
Assault family violence (or domestic violence) is usually a Class A misdemeanor carrying a possible range of punishment of up to 1 year in the county jail and up to a $4,000 fine. Assault family/domestic violence involving impeding the breathing or circulation of the victim enhances the case to a third degree felony carrying a possible range of punishment of 2 - 10 years imprisonment and up to $10,000 fine. Assault family/domestic violence with a previous affirmative finding of family violence is also enhanced to a third degree felony.
